There is no average Alabama car accident settlement worth knowing, and any page that gives you one is guessing. What there is: a short list of things that set the number, and most of them are knowable within a few months of the wreck. Here is how a Birmingham injury lawyer actually values a claim, and what pulls the number down.
What goes into the number
Medical bills, past and future, at the amounts billed. Lost wages and, for a lasting injury, lost earning capacity. Out of pocket costs such as prescriptions, mileage to treatment, and help around the house. And pain and suffering, which Alabama leaves entirely to the jury with no formula and no cap, and which in practice is the largest part of a serious case. If the other driver was wanton, meaning drunk, racing, or running a red light at speed, punitive damages are available on top, subject to Alabama’s statutory cap for cases other than wrongful death. Property damage is handled separately and early.
The ceiling: insurance limits
A claim is worth what can be collected. Alabama requires only $25,000 per person in liability coverage, and a large share of drivers carry exactly that or nothing. Against a minimum-limits driver with no assets, a $200,000 injury is a $25,000 claim unless there is other coverage: the driver’s employer’s policy if he was working, an umbrella policy, or your own underinsured motorist coverage, which Alabama lets you stack across up to three vehicles on your policy. Finding every policy is the first job in valuing a case, and it is where many claims are underpaid by lawyers who stop at the other driver’s card.
The floor: contributory negligence
If the insurer can make a credible argument that you were partly at fault, Alabama’s contributory negligence rule lets a jury award you nothing. The insurer prices that risk into every offer. A rear end collision at a red light with a police citation against the other driver carries almost no discount. A wreck where both drivers say the other ran the light, with no witnesses and no video, carries a large one. That is why the evidence gathered in the first week, video, witnesses, the other driver’s phone records, changes the value of the case more than anything that happens afterward.
The injury itself
Soft tissue injuries that resolve with a few months of conservative treatment settle for a modest multiple of the medical bills. Fractures, surgeries, injections, and anything that leaves a permanent impairment are valued differently, often with a treating physician’s opinion on future care. Gaps in treatment, missed appointments, and a prior injury to the same body part all reduce the number, because the insurer argues the wreck did not cause what the records show. Consistent treatment and honest reporting of symptoms are worth real money.
Where the case would be tried
Insurers value a Jefferson County case differently from a Shelby County case because the juries differ, and both differently from Madison County. A Birmingham Division jury is generally a better venue for an injured plaintiff than Columbiana. The adjuster knows the location of the wreck before you do, and the number reflects it.
What comes out before you see it
The attorney’s fee and case expenses. Then the liens: your health insurer’s right to be repaid, Medicare or Medicaid’s, and any hospital’s under Ala. Code § 35-11-370. Alabama allows the defense to show the jury what insurance already paid (§ 12-21-45), and the lienholders will claim their share of the settlement. Negotiating those liens down after the number is agreed often improves your net by more than the last round with the adjuster did. Ask any lawyer you talk to what they do about liens; if the answer is nothing, keep looking.
How to get an actual number
Send the firm the crash report, your declarations page, and the names of where you have treated.
